Bitget Savings Agreement

Prior to purchasing Bitget Savings products (hereinafter referred to as Savings), users are requested to read the entire Bitget Savings Agreement (hereinafter referred to as the Agreement) carefully and fully understand the Agreement and its terms and conditions. If the user has any questions about this agreement, do not proceed to the next step.

By using the Bitget platform (hereinafter referred to as "we", "the platform" or "Bitget") and its services, and confirming through the website page or any other means of acceptance of this Agreement, the user is deemed to have fully understood all of the terms of this Agreement and thereby agrees to enter into this Agreement with us.

Note: In the event that the user possesses any uncertainties or objections regarding the contents of this Agreement prior to agreeing to its terms, we kindly urge the user to reach out to us. This will allow us to provide the user with explanations and further clarification, thereby assisting the user in making an independent decision about whether or not to accept this Agreement and utilize our services.

1. Disclaimer

1.1 Legal statements

Prior to utilizing the services we provide, the user is requested to confirm that they do not reside in a restricted region (including but not limited to the United States, the Balkans, Belarus, Burma, Ivory Coast, Crimea-Ukraine, Cuba, the Democratic Republic of the Congo, Iran, Iraq, Liberia, North Korea, the Sudan, Syria, Venezuela, and Republic of Zimbabwe), and that the user's country or region sanctions the usage of the services provided by us. Any legal risks and liabilities stemming from the utilization of Bitget's services in a country or region where said usage is prohibited shall be solely assumed by the user. When engaging with the Savings services, it is important for the user to fully understand the risks associated with investing in digital assets, acknowledge the absence of guaranteed returns, and exercise caution when making trading decisions.

1.2 Statement regarding force majeure risks

1.2.1 In the event that either party is hindered from fully or partially executing this Agreement, or experiences a delay in doing so due to a force majeure event, said party is obligated to promptly inform the other party about the event in writing or electronically within twenty days from the occurrence of said force majeure event.

1.2.2 The party subjected to the force majeure event shall take all necessary measures to minimize any losses and resume the performance of this Agreement as soon as the event is eliminated, unless such performance is impossible or not necessary.

1.2.3 We shall not be held liable for any disparities between the anticipated and actual outcomes of the financial investment service caused by force majeure factors.

1.2.4 The term "force majeure" in this Agreement refers to objective events that cannot be foreseen, avoided or overcome, including but not limited to natural disasters (floods, fires, explosions, lightning, earthquakes, storms, etc.) and social events (wars, turmoils, governmental control, sudden changes in national policies and laws, strikes, attacks by hackers or computer viruses, technical adjustments of telecommunication departments, etc.)

1.3 Revision of the Agreement

Taking into account the continuous development and evolution of the nature and content of Internet information services, the user agrees that Bitget reserves the right to modify the terms of this Agreement and to notify the user of such modifications by posting them online or by any other reasonable means. The user agrees to visit the website regularly and frequently to review the most updated Agreement. Should the user disagree with the revised Agreement following such modifications, the user shall discontinue the registration process and refrain from further usage of the services offered by Bitget. By continuing to utilize Bitget's services, the user will be deemed to have accepted and agreed to abide by this updated Agreement.

2. Definitions

2.1 T Day: Refers to a natural day measured in Singapore time.

2.2 Distributable Earnings: This denotes the portion of operational earnings, obtained by Bitget through the provision of various services based on locked-in tokens and backed by sound risk management and system security, after deducting essential expenses.

2.3 Lock Up: The act of locking up specified tokens within Bitget Earn products as per the agreed terms.

2.4 Unlock: The act of unlocking and withdrawing tokens to the user's spot account within the agreed upon time.

2.4.1 Unlocking is redemption: Once the agreed-upon time or unlocking time elapses, the locked tokens in the mining pool will generally be automatically withdrawn to the user's spot account.

2.4.2 Users can choose between fixed term products and flexible term products. Fixed term products can be redeemed in advance, while flexible term products can be accessed flexibly.

2.4.3 Special tokens are restricted by the on-chain rules, and the withdrawal time should be set according to the on-chain rules of the token.

3. User representations and warranties

3.1 The user hereby makes the following representations and warranties to us. These representations and warranties will be considered reiterated each time the user utilizes the services:

3.1.1 In the case of an individual, the user affirms that they are at least 18 years of age or any other legal age mandated by applicable law to enter into a contract. Moreover, the user asserts that they have the necessary authority under relevant laws and regulations to engage in a binding contract and fulfill their obligations as outlined in this Agreement.

3.1.2 In the case of a legal person or organization, the user asserts that they have the necessary legal capacity and authorization to enter into this Agreement, and that the user's obligations under this Agreement are binding on the user.

3.1.3 The user affirms that their utilization of Bitget's services does not infringe upon or contradict any relevant laws that pertain to them. Furthermore, the user ensures that their actions do not breach any contractual limitations binding upon them or affecting the assets utilized in connection with our services. The user confirms that they have not faced any economic sanctions imposed by any pertinent government or international administration, including but not limited to entities such as the United States Treasury Department's Office of Foreign Assets Control, the United States Department of State, the United Nations Security Council, the European Union, Her Majesty's Treasury, the Hong Kong Monetary Authority, or the Monetary Authority of Singapore.

3.1.4 The user confirms that their usage of the services is solely for their personal benefit and further asserts that they do not employ the services on behalf of third parties or have any partner beneficiaries, unless they have obtained our prior approval.

3.2 With respect to the registration data and information provided by the user (registration information), the user agrees to the following:

3.2.1 The user confirms that the registration information provided is lawful, authentic, accurate, and complete.

3.2.2 The user will promptly notify Bitget of any changes to the registration information provided. If the registration information provided by the user is found to be unlawful, inauthentic, inaccurate, or incomplete, the user shall bear full responsibility for the resulting consequences.

3.2.3 Bitget reserves the right to impose certain restrictions on accounts and/or to temporarily suspend or terminate the user's access to Bitget services based on the user's provided registration information and in alignment with Bitget's compliance responsibilities and internal risk control policies.

3.2.4 Unless expressly approved in writing by Bitget beforehand, each user is permitted to create and register only one account with Bitget.

3.2.5 Bitget reserves the right to request the user to provide the account owner's identifying and/or financial information for compliance purposes such as KYC (Know Your Customer) verification and/or anti-money laundering.

3.2.6 The user is required to enter their respective user name and password to use certain features of the services provided by Bitget. In the event that the user is unable to access their account due to reasons such as forgetting their account password, Bitget reserves the right to request certain information, including identifying information, in order to determine true ownership of the account, including but not limited to: proof of identity, proof of residency, proof of phone number/email and any identifying information about their activity on the website, such as transaction IDs, order numbers, withdrawal amounts, etc. The user undertakes that they shall not share their username and/or password with any other individual or entity, or grant access to their account to any third party. Bitget shall not be liable for any unauthorized use of the user's account or password by the user or any third party, nor for any consequences or losses arising thereof. If the user suspects that their username and/or password has become known to another individual, or if they suspect unauthorized use of their account by a third party, they are obligated to promptly inform Bitget.

3.2.7 When using the service, the user shall comply with national laws, ensure that the source of their cryptocurrency assets is legal and compliant, and refrain from engaging in money laundering or any other unlawful activities.

4. Risk communication

4.1 The user understands and acknowledges that engaging in the purchase of financial products and the associated services linked to their operation entails inherent risks. The list of risks provided in this Article 4.1 is not exhaustive, and Bitget reserves the right to unilaterally determine such risks. These risks, as well as others that may arise now or in the future, may prevent the user from obtaining any benefits, result in suffering financial losses, or even lead to the termination of the services we provide:

4.1.1 The purchase of financial products and the related services arising from their operation carry inherent financial, regulatory, and various other risks. Before purchasing financial products and the associated services resulting from their operation, users should ensure that they possess adequate knowledge and experience in blockchain technology, as well as a comprehensive understanding of the features and risks of the respective financial products. Any decision by the user to purchase financial products and related services arising from their operation should be based on independent investigation and/or professional advice as deemed necessary by the user. Bitget operates under the assumption that users are professionals who possess industry knowledge and a clear understanding of the risks linked to the services which they engage with. It's important to note that neither this Agreement nor any of the services provided by Bitget should be construed as advice from Bitget to the user.

4.1.2 The value of any financial product offered by Bitget may be affected by a number of factors outside of Bitget's control, including but not limited to changes in the parameters / attributes of the financial product, fluctuations in market prices, and outdated hardware.

4.1.3 From time to time, Bitget will conduct system maintenance or upgrades. The user acknowledges that they should not anticipate the services provided by Bitget to be continuous and uninterrupted. Unless otherwise expressly agreed by the parties, Bitget shall not be liable for any and all losses resulting from suspensions and interruptions due to any system maintenance or upgrades.

4.1.4 No verification method or computer security technology is completely secure. The user agrees to assume all risks associated with hacking events or identity theft.

4.1.5 The user understands and agrees that Bitget reserves the right to publish, modify and/or provide information related to the services through its website, email, customer service calls, messages and other official channels. Bitget is not responsible for information obtained through non-official channels. Should the user have any doubts about the authenticity of information sent on behalf of Bitget, the user shall contact us immediately.

4.2 Before purchasing any financial product offered by Bitget, the user shall determine whether the financial product aligns with their financial capacity and risk tolerance. By purchasing any financial product offered by Bitget, the user recognizes, understands and accepts all risks associated with activities such as mining, purchasing, selling, exchanging and holding the financial products, including but not limited to:

4.2.1 Large fluctuations in market prices: Prices may fall sharply, perhaps even to zero.

4.2.2 Transactions may take some time to be confirmed. Although the likelihood might be low, it's important to acknowledge that there is a possibility that certain transactions may never be confirmed. Unconfirmed transactions represent that they have not been completed.

4.2.3 The transaction is irreversible. If the user sends any amount of funds to an incorrect address, the user will be unable to cancel the transaction or recover those funds.

4.2.4 Funds may be lost or unavailable to the user if the user loses or forgets any necessary PIN or password required for access and use.

4.2.5 There may be unknown technical flaws inherent in blockchain technology.

4.2.6 New laws, regulations and policies may be introduced and enacted in different countries / regions that affect the fulfillment of this Agreement.

4.2.7 Project risks: DeFi projects involve uncertainties such as unanticipated contract vulnerabilities, hacker attacks, and the potential discontinuation of on-chain projects.

5. This Agreement will be translated into multiple languages. In the event of any discrepancies, the Chinese version shall prevail.

6. Bitget reserves the right to the final interpretation of the Agreement.
