I Don’t Have Power to Investigate WazirX Hack, says Singapore Judge Who Granted Moratorium

Singapore’s Judicial Commissioner of the Supreme Court, Kristy Tan, clarified to WazirX users during a hearing of a moratorium application, that she did not have the authority to order the Singapore Police Force to investigate the cyber hack, nor could she direct the Indian police to do so.

The comments were made by Tan on September 26 during an online court hearing of WazirX moratorium application, after several WazirX users insisted through chat messages that the judge should direct a police enquiry into the Rs 2000 crore hack . The court transcript documents were made available on Monday, October 14, after WazirX mailed it to all users, following the directives of the Singapore court .

During the live Zoom hearing, Kristy Tan told WazirX creditors, “The first thing you need to understand is that the Singapore Court does not have the power to order our Singapore Police Force to do anything.”

While these statements disappointed WazirX victims, she clarified that the hearing was solely about assessing the WazirX moratorium application and deciding whether to approve it.

The court had already granted a four-month moratorium period to Zettai Pvt Ltd on September 5. To assess the WazirX moratorium application, the court considered a WazirX survey, where a poll was conducted to gauge how many creditors supported the moratorium application.

In the poll, 78,011 out of 4.4 million creditors participated, collectively representing claims of $82 million. Of these, 72,120 respondents voted in favor of the moratorium application, representing 92.45% of the claims, or around $64 million.

On the flip side, 1,491 creditors opposed the moratorium application, holding 1.91% of the claims, amounting to $203 million.

Now that the complete focus has shifted to Zettai’s restructuring plan, a few people are still concerned about the WazirX hack, demanding an independent investigation to trace the root cause of this bizarre hacking incident.
